MahaRERA took quick action and issues Recovery Warrant against Sodhi Builders and its partners under section 40(1) of RERA so that the money can be repaid to the Actor Sudip Pandey

Mumbai, July 19, 2019: Under the warrant, the Palghar district collector, Dr Prashant Narnaware could attach the property and if the developer does not pay up still, bidding process could be initiated. This warrant has been issued by the authority after the complainant film actor Sudip Pandey approached MahaRERA on several occasions asking for execution of the earlier order against the builders directing refund of the money with an interest of 10.55% thereon. Under the warrant, the district collector of Palghar will attach the property and if the developer still does not pay the money then auction process will be initiated.

Sudip Pandey, had booked 2 flats in the project by Sodhi Builders named Sodhi Presidency, located at Vrindavan Nagari in Pam Tembhi, Navapur Road, Boisar West had sought a refund of the amount paid by him as the builder had adopted various unfair practices and delayed possession. He had approached MahaRERA in August 2018.

The RERA Authority passed an order for compensation and interest in February,2019, the builder had 45 days to execute the order and provide the compensation to the actor but the builder failed to comply with the order, Sudip Pandey then filed for the execution of RERA complaint against the Sodhi builders with the same RERA Authority. The adjudicating officer issued a showcase notice and called upon the promoters to appear on 8th July,2019 but they failed to appear, and consequently the warrant was issued.

Sudip Pandey said “I met officials at the collector office in Palghar on 9th July. I was told that as per the rules, in this case,  the developer will be given a chance to produce the property card failing which he can be sent to jail . The collector then issues an attachment certificate, post which the property is attached and the amount is paid. If he fails to do so, then the auction process will be followed . I appreciate the fast action taken by RERA and though it’s a tedious process when you are fighting to recover your hard earned money, I have full faith in the system.”
