United IPR Hosts Conference on ‘Intellectual Property through Collaborative Enforcement Best Practices in IPR’

New Delhi, June 21, 2019: United IPR, country’s leading full-service Intellectual Property Firm known for its IPR prosecution, litigation and entrepreneurial and operational skills today organised a conference on ‘Intellectual Property through Collaborative Enforcement Best Practices in IPR’ in association with PHD Chamber of Commerce and Industry at PHD House, New Delhi. The conference was presided by Chief Guest, Hon’ble Mr. Justice Dipak Misra (Former Chief Justice of India). Other dignitaries who graced the event include Hon’ble Mr. Justice Manmohan Singh, Chairman of IPAB; Shri Rajeev Talwar, President of PHD Chambers; Mr. Suvashis Chaudhary, (I.P.S.) Additional Commissioner of Police, Economic Offence Wing;  Mr. N. R. Meena, Deputy Controller Patents & Designs; Professor C. J. Rawandale, Director, Symbiosis Law School, Noida;  and Mr. Sudarshan Kumar Bansal, Partner, United IPR.

The Conference discussed growth and development of IPR regime in India, steps taken by the government to promote IP besides the role of judiciary and law enforcement agencies in enforcement of IPR laws in the country. It provided a platform / major opportunity for interaction among educators, organisations, judiciary, enforcement agencies, law practitioners and representatives from the industry to form fruitful and long-term collaborations to enforce IP Laws.

Delivering the special address, Hon’ble Mr Chief Justice of India, Dipak Misra (Retd.) said, “Collaborative Enforcement of Creativity, Innovation and Invention” and stressed on the need for “Intellectual Vigilance” so that Right holder shall get due credit for his creation and any wrong doer should not be allowed to encroach upon the rights and creativity of another.

Guest of Honour, Hon’ble Mr Justice Manmohan Singh, Chairman of IPAB in his keynote address discussed the entire jurisprudence of the enforcement and development of the Intellectual Property Rights regime in India.

Talking about the steps taken by Government of India to promote IP in India Mr NR Meena, Dy. Controller General of Patents and Designs enumerated upon the key developments made with respect to development and enforcement taken up by the Office of Controller General of Patents, Designs and Trade Mark and have been working towards creating awareness amongst the public regarding counterfeits and IPR Enforcement Mechanisms.

Moving towards an Institutional and Academic Perspective, Professor C.J. Rawandale addressed the gathering on the need to change the outlook in terms of understanding Intellectual Property as a Right and its need to be protected.

Sharing best practices for IPR enforcement in India, Mr. Sudarshan Kumar Bansal, Partner, United IPR stressed on the applicability of the rule of law in the enforcement of Intellectual Property Rights. He pointed out that there are adequate laws and mechanisms present in India however there is an imminent need to create effective awareness and prioritize the same and IPR laws if well used can be a great stimulus for business development.

Menace of fake and counterfeit goods (both online and offline spheres) is adversely affecting the economy as well as the consumers. It is one of the major challenges that is faced by the IP right holder. Against this backdrop, the conference featured a session on ‘Enforcement of IPR in the markets of India and at the territorial borders’ by Mr. Gaurav Gogia, Advocate and Senior Associate, United IPR; Dr. H.P. Kumar, PHD Chamber of Commerce; Mr. Mahesh Kumar, Deputy Commissioner of Customs and Mr. Amardeep Sehgal, Assistant Commissioner of Police (Economic Offences Wing). This was followed by a panel discussion on ‘Online Enforcement of IPR’ featuring experts from the legal world and industry’. The panelists included Mr. Naveen Chandra Kushwaha, (Head Legal, Luxottica, India); Mr. Sushant Singh, Advocate; Dr. H.P. Kumar, PHD Chamber of Commerce; Mr Rishi Bansal, Advocate, Managing Associate, United IPR; Mr. Shivang Bansal, Managing Associate, United IPR; Mr. Gaurav Gogia, Advocate and Senior Associate, United IPR; Mr. Yahya Sabir, Brand Protection Analyst, United IPR and Ms. Krati Jain, Advocate and Associate, United IPR. The discussion drew references to Counterfeit Products being freely circulated and sold through several E-commerce platforms.  The panelists agreed that there is an imminent need to combat the menace of online counterfeiting.

The conference also featured presentations on IPR Enforcement from legal counsels of leading brands like P&G, Luxxotica, Hugo Boss, LBrands and Lacoste. Representatives of these brands stressed on the urgent need to have a structured framework and well stringent measures to curb the circulation of counterfeits. 

The conference saw active participation of over 250 delegates from legal fraternity and industry from Delhi NCR region. This include senior lawyers, law faculty members, students and senior officials from law enforcement agencies.
